中大网校：一级建造师考试项目管理考点：建设工程的招标与投标

施工招标应具备的条件：①招标人已经依法成立②初步设计及概算应当履行审批手续的，已经批准③招标范围、招标方式和招标组织形式等应当履行核准手续的，已经核准④有相应资金或资金来源已经落实⑤有招标所需的设计图纸及技术资料。 宜采用招标方式确定承包人的项目：①大型基础设施、公用事业等关系社会公共利益、公众安全的项目②全部或者部分使用国有资金投资或者融资的项目③使用国际组织或者外国政府资金的项目 招标分为①公开招标②邀请招标两种方式。公开招标亦称无限竞争性招标，招标人在公共媒体上发布招标公告，提出招标项目和要求，符合条件的一切法人或者组织都可以参加投标竞争，都有同等竞争的机会。邀请招标亦称有限竞争性招标，招标人事先通过考察和筛选，将投标邀请书发给某些特定的法人或者组织，邀请其参加投标。采用邀请招标，应向三个以上的法人或者组织发出投标邀请书。 采用邀请招标的情况：①项目技术复杂或有特殊要求，只有少量几家潜在投标人可供选择的②受自然地域环境限制的③涉及安全、秘密或者抢险救灾，适宜招标但不宜公开招标的④拟公开招标的费用与项目的价值相比，不值得的⑤法律、法规规定不宜公开招标的。 招标人自行办理招标事宜，应当具有编制招标文件的能力和组织评标的能力。 招标公告应当载明①招标人的名称和地址②招标项目的性质、数量、实施地点和时间③投标截止日期④获取招标文件的办法 自招标文件或者资格预审文件出售之日起至停止出售之日止，较短不得少于5个工作日。招标人若对招标信息进行修正，应当在招标文件要求提交投标文件截止时间至少15日前发出，所有澄清文件必须以书面形式进行，并应直接通知所有招标文件收受人。 标前会议也称为投标预备会或招标文件交底会，是招标人按照投标须知规定的时间和地点召开的会议。当补充文件与招标文件不一致时，以补充文件为准。 初步评审主要是进行符合性评审，即重点审查投标书是否实质上响应了招标文件的要求。详细评审是评标的核心，是对标书进行实质性审查，包括技术评审和商务评审。 评标委员会推荐的中标候选人限定在1 至3人，并标明排列顺序。 1Z206012 施工投标的内容 施工投标的程序：①研究招标文件②进行各项调查研究③复核工程量④选择施工方案⑤投标计算⑥确定投标策略⑦正式投标 1Z206013 合同的谈判与签约 建设工程合同的订立采取要约和承诺方式。 招标公告和招标文件为要约邀请，投标文件为要约，中标通知书为承诺。 依据计价方式不同，建设工程施工合同分为总价合同、单价合同和成本加酬金合同。建设工程施工合同的付款分为四个阶段进行，即：预付款、工程进度款、较终付款和退还保留金。
